Effective Date: August 22^nd, 2025

This Rental Agreement (“Agreement”) is entered into between Study with Skelly (“Company,” “we,” “our”) and the individual renting a kit (“Renter,” “you”). By completing payment and accepting delivery of a rental kit, you agree to the following terms and conditions.

1. Eligibility

• You must be at least eighteen (18) years old to enter into this Agreement.
• Rentals are intended for educational use only. Minors may use kits only under the supervision of an adult renter.

2. Rental Fees and Payment

• Rental fees are due in full at the time of payment.
• Payment is processed through approved providers (e.g., Stripe, PayPal).
• By renting a kit, you authorize Study with Skelly to charge your payment method for any applicable late, damage, or replacement fees under this Agreement.

3. Rental Period

• The rental period begins on the date of payment.
• The rental period ends on the last day of the academic semester in which the kit was rented (“Return Deadline”).
• Kits not returned by the Return Deadline are subject to late fees (see Section 4).

4. Returns and Late Fees

• Kits must be returned directly to Study with Skelly at the Sierra College anatomy labs or another mutually arranged location.
• Late fees apply as follows:
  • 1–7 days late: $40
  • 8–30 days late: $80
  • 31 or more days late: Replacement cost of $400
• Failure to return a kit within thirty-one (31) days after the Return Deadline will result in the kit being deemed lost, and you will be charged the full replacement cost of $400.

5. Damage, Loss, or Missing Items

• You are responsible for the care of the kit while in your possession.
• In most cases, you will be charged only for the replacement cost of the missing or damaged bone or component, plus a reasonable handling fee.
• In rare cases, where significant damage or loss has occurred, you may be charged the full replacement cost of the kit ($400).
• All determinations of damage and applicable fees are made at the sole discretion of Study with Skelly after inspection upon return.

6. Money-Back Guarantee

Study with Skelly offers a limited money-back guarantee under the following conditions:

1. Eligibility: Applies only to students who rented a skeleton kit and failed the skeletal identification portion of their anatomy lab practical at a U.S.-based accredited college or university.
2. Evidence Required: You must submit a clear photograph of your graded lab practical showing all skeletal identification questions, correct and incorrect responses, and the instructor’s scoring. Study with Skelly will determine whether you failed the skeletal section in its sole discretion.
3. Definition of Failure: Failure means not achieving a passing score for the skeletal section as determined by your instructor’s grading standards. Missing a small number of questions does not qualify.
4. Timeframe: Refund requests must be submitted within thirty (30) days of the exam date.
5. Refund Amount: Approved refunds equal the full rental fee paid for the skeleton kit only. Shipping, digital resources, and other charges are nonrefundable. Refunds are issued to the original payment method.
6. Condition of Return: Kits must be returned in full and in good condition before a refund is processed. Any late, damage, or replacement fees will be deducted from the refund.
7. Limitations: Only one refund may be claimed per rental transaction. Refunds are not available for non-skeletal rentals, nonattendance, or unrelated reasons. Refunds are non-transferable.
8. Final Decision: All refund determinations are final and made at the sole discretion of Study with Skelly.

7. Use of Kits & Restrictions

• Kits are provided for educational purposes only and are not intended for medical advice, diagnosis, or treatment.
• You may not transfer, sub-rent, or loan the kit to others.
• Kits may be taken off-campus, off-site, and internationally, provided they are returned by the Return Deadline.

8. Online Resources

• If bundled access to online resources is provided, access will be granted by a one-time code or link.
• Access is for your personal use only and may not be shared, copied, or redistributed.
• Online resources are owned by Study with Skelly and protected by intellectual property laws.

9. Liability Disclaimer

• You assume full responsibility for safe use of the kit.
• Study with Skelly is not liable for any injury, property damage, or incidental loss resulting from the use, transport, or possession of the kit.
• Study with Skelly is not responsible for academic outcomes except as expressly provided in the Money-Back Guarantee.

10. Marketing Permission

• By submitting a testimonial, photograph, video, or other content to Study with Skelly, you grant Study with Skelly a perpetual, worldwide, royalty-free license to use, reproduce, and publish such materials for marketing, promotional, and educational purposes in any format or media.

11. Force Majeure

• Study with Skelly is not liable for delays or failure to perform obligations under this Agreement due to causes beyond its reasonable control, including but not limited to natural disasters, pandemics, strikes, or campus closures.

12. Governing Law and Disputes

• This Agreement is governed by the laws of the State of California.
• Any dispute arising from this Agreement will be resolved by binding arbitration under the rules of the American Arbitration Association.
• You waive the right to participate in any class action or class-wide arbitration.

13. Entire Agreement

• This Agreement, together with the Privacy Policy and Terms of Service, constitutes the entire agreement between you and Study with Skelly.
• This Agreement supersedes all prior communications or understandings.

14. Copy of Agreement

• A copy of this Agreement will be provided to you by email following completion of your rental.
